Tandem Privacy Policy Last Updated: June 25, 2020 This Privacy Policy ("Privacy Policy") explains the information Join Tandem Inc. ("Tandem") may collect from users of our service. This Privacy Policy applies to users of our website at join-tandem.com (our "Site"), our Tandem mobile application for sitters ("App") and our text based service for parents, grandparents and legal guardians (collectively, our "Services"). This Privacy Policy also describes how we can use and disclose information collected from you, the security practices we use to protect the information, and what choices you have regarding how your information can be used or disclosed. In this Privacy Policy, Tandem may also be referred to with terms such as "we," "us," or "our," and users of our Services are referred to with terms such as "you" and "your." Parents, grandparent or legal guardians who are looking for help caring for their child or grandchild are referred to as "Parents" and persons who are willing to provide that care are referred to as "Sitters." Other capitalized terms that are not defined in this Privacy Policy have the meaning of them in the Tandem Terms of Use. Please read this Privacy Policy carefully before using our Services. If you do not agree with the terms or this Privacy Policy, do not accept them. However, if you do not accept the terms of the Privacy Policy, you cannot use our Services. By agreeing to the Privacy Policy and using the Services, you consent to the collection, use disclosure, and other processing of your personal and technical data as described in this Privacy Policy. We reserve the right to modify or replace this Privacy Policy at any time in accordance as described below in Changes to Our Privacy Policy. Information We Collect The information we collect depends on which portion of the Services you use and whether you are a visitor to our Site, a Sitter or a Parent. You can use our Site without providing any information other than as automatically collected (as described below). Parents seeking to use our Service must provide information about themselves and about their children. Sitters seeking to use our Service must provide us with information about themselves. Much of the information we collect is information that identifies you as a particular person ("Personal Information") and will be stored by us. Information provided by you You may provide us with information in various ways, including: When seeking a Sitter for the first time When a Parent seeks a Sitter for the first time, the Parent must provide the following information about the Parent by filling out a form. If the phone number you use to text us is a number we haven’t seen before, we will send you a link to a sign up form that will ask you for your: First and last name Email address Home address Phone number Bank account information We will also ask you for the following information about each child: Age Health and allergy information, if you choose to provide it Desired qualifications of the Sitter, if you choose to provide it (e.g. whether the Sitter can drive, whether the Sitter has use of a motor vehicle, minimum age, languages spoken, level of education, first aid/CPR certification, whether the Sitter has been reference and background checked, etc.) We will store all of this information in our records for future use. When seeking a Sitter for a particular date and time When a Parent seeks a Sitter for a particular date and time, we collect and store the following information: Desired date and time Location Desired qualifications (e.g. ability to drive) Health and allergy information, if you choose to provide it Any other information you choose to provide When applying to be a Sitter If you are a Sitter, we may collect and store a variety of information including: First and last name Email address Home address Age Phone number Qualifications (e.g. whether you can drive, whether you use of a motor vehicle, level of education, first aid/CPR certification, languages spoken, whether you have been background checked, etc.) Information needed by us to initiate a background check on you (Name, Social Security number, address, and date of birth) Reference name and contact information Any other information you choose to provide for your bio to be given to Parents When contacting us by telephone If you contact us by phone, we may collect and store any information you chose to provide to us. Telephone calls with us may be recorded or monitored. We will provide you with notice at the time you call if your call will be recorded or monitored. When contacting us by email or regular mail If you contact us by email or regular mail, we may collect and store your correspondence and any information you chose to provide to us. Information provided by others Information obtained for safety and verification purposes We may use third party sources or service providers for safety purposes and to verify information you provide to us. These may include, among others, sex offender registries, criminal databases, terrorist watch lists, public search engines, social media and private investigators. Background checks We provide limited background checks on each Sitter upon sign-up. We currently use Evident ID Inc. to perform these limited background checks. We may in the future provide Sitters with the ability to request a more complete report from a third-party background check firm or consumer reporting agency. Sitters may be required to provide additional information, including Personal Information, to the applicable service provider in order to complete the report or check. All reports and background checks will be subject to the terms and conditions of the service provider that conducts the investigation and our Terms of Use. Payment service providers We may receive information about you from payment processors, banks or debit card issuers, such as information necessary to transmit payments or confirmation that payments have been transmitted or received. Information you authorize us to collect We may from time to time request permission to collect information from or about you, such as information about your location (e.g., GPS-based functionality on mobile devices you use in connection with the Services). Information collected automatically We may automatically collect certain information about the computer or mobile devices you use to access the Services including: IP addresses and other technical information We use cookies and other technology to track and access certain digital information or data found on your computer or mobile device, such as: The Internet Protocol (IP) address of your computer, smartphone or other devices Information related to your computing device, browser or operating system type. Your check ins to the Site or our App Your activity within the Service (views, content visited, time spent on certain content or activities, the number of times you visit a page, etc,) Emails or text messages you open Links you click Cookies A "cookie" is a small amount of data that is sent to your browser from a web server and stored on your computer's hard drive. Websites, mobile apps, and advertisements that you access or use can place and use cookies to recognize repeat users or track web usage behavior. If you do not want information to be collected through the use of cookies, your browser allows you to deny or accept the use of cookies. There may, however, be some features of the Services which require the use of cookies in order to customize the delivery of information to you. We cannot control the use of cookies (or the resulting information) placed by third parties. We do not have access to the information from third party cookies. The use of cookies by third parties is not covered by our Privacy Policy. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of the Services. Web beacons We may also use web beacons to access our cookies. A web beacon is an electronic file on a page that allows us to count users who have visited that page and to recognize users by accessing our cookies. Do not track Tandem does not track users across websites or applications operated by third parties, and therefore does not use or respond to "do not track" ("DNT") signals in your web browser. However, some third-party websites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. Certain website browsers allow you to set the DNT signal on your browser so that participating third parties (particularly advertisers) know you do not want to be tracked. How We Use Information The information we collect is used to administer, provide and improve our Service. We may use your information in a variety of ways, including the following: Create an account for you; Build Sitter bios or profiles for presentation to Parents; Match Sitters with jobs posted by Parents; Obtain additional information; Respond to questions; Provide information you have requested; Verify information you provide us; Obtain reports and background checks; Process payments; Diagnosis and repair problems with the Service; Notify you about changes to or new features of the Service; Provide information that we believe will be of interest to you; and Perform analytics designed to improve the Services. We use your IP address and other automatically collected information about your computing devices to help diagnose problems, to administer the Service and to gather broad demographic data. We will not store or link your IP address to any Personal Information we have collected about you. We may aggregate or de-identify information collected by the Site or the Services in a manner that prevents the information from being used to identify you. Aggregated or de-identified information may be used by us or disclosed to third parties without limitation or restriction. How We Share Information We may share your information with third parties as follows: With your consent We may share your information with a third party if you expressly consent to the sharing. When Sitters are paired with Parents When we find a Sitter that matches a Parents requirements, we provide the Parent with the Sitter’s name, bio and qualifications (whether the Sitter can drive and has a motor vehicle, level of education, first aid/CPR certification, reference and background checks, etc.). We do not provide the Parent with the Sitter’s personal phone number, but instead provide a phone number that we set up for each Sitter for contact through the App. We don’t provide the Sitter with the Parent’s name, contact information or address for the job (other than a statement of the general geographic area in which the job is located), until the Sitter has accepted the job and been confirmed. Service providers We may employ companies and individuals ("Third-Party Service Providers") to support us in offering the Services. These Third-Party Service Providers may provide maintenance services and help us to improve the Services. These Third-Party Service Providers may have access to your Personal Information, but only to the extent needed to perform tasks on our behalf; our contract with them will require them to protect and safeguard your Personal Information to the same extent we are required to do so under this Privacy Policy. Card issuers and banks We will share your Personal Information and other information necessary for payment processing with debit card issuer and banks. Reference checks We may use the information Sitters provide us to contact references and confirm information about Sitters and to verify that Sitters are suitable for our Services. We may note in your bio or profile that we have completed reference checks. Background checks We use Evident ID Inc. to perform limited background checks on all Sitters. We will provide Evident with the following information collected from Sitters for the purpose of completing the check: Full name, address, date of birth, and Social Security number. Evident will send us the results, which we retain in our files, and may also send the results to you by email or regular mail. We may note in your bio or profile that you have completed the background check. You understand and agree that sensitive information may be included in your background check, that we will have access to that information and that you are solely responsible for providing correct information to ensure the accuracy of the check. Law enforcement and safety We may cooperate with government and law enforcement officials, agencies and private parties to enforce the law. We may disclose your Personal information to government or law enforcement officials, agencies or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal processes (including but not limited to subpoenas), to protect the property and rights of Tandem or a third party, to protect the safety of the public or any person, or to prevent or stop activity that we may consider to be, or to pose a risk of being, unsafe, illegal, unethical or legally actionable. Business transfers In the event we undergo an acquisition by another company, a merger, or sale of all or a portion of our assets, or in the event that we go out of business or enter bankruptcy, your Personal Information may be among the assets transferred or acquired by a third party. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of ours or that acquirer's affiliates may continue to process your information as set forth in this Privacy Policy. Your Choices Regarding the Sharing of your Personal Information When we request information from you, some of the information will be required in order to use the Services and other information will be optional, in which case you do not have to provide that information. We may offer you the right to choose whether we may share certain information and for what purposes. If we offer you that right, your choice will apply only to that information and not to any other information we may have collected. Changing or Removing your Personal Information and Closing your Account If your Personal Information changes, or if you no longer desire to participate in the Service, or if you wish to update your preferences to receive email or other communications from us, you can add, correct or delete certain information. Sitters can update their information by logging into their “my profile” page on the App. Parents can update their information by text messaging us. You can also contact us by email or regular mail at the address at the bottom of this Privacy Policy. We will use reasonable efforts to respond to your request within 30 days. If you close your Tandem account, we will not include you in any pairings between Parents and Sitter. If you close your account, we have no obligation to retain your information, and may delete some or all of your information without liability. However, we may retain information related to you if we believe it may be necessary to prevent fraud, for safety of persons or property, enforcing our rights and obligations under our agreements, or if required by law. Collection of Information from Children Our Services are not available for individuals under the age of 13. If we become aware that we have collected Personal Information from children under the age of 13, we will delete that information as soon as reasonably possible. How We Protect Information We use various administrative, technical, and physical security measures to protect your Personal Information and other information against unauthorized access or release. We cannot, however, guarantee the security of our database, nor can we guarantee that information you supply won't be intercepted while being transmitted to us over the Internet or phone systems, and any information you transmit to us is at your own risk. We encrypt password information. We recommend that you use unique numbers, letters and special characters in your password and not disclose your password to anyone. If you do share your password or other account information with others, you are responsible for all actions taken in the name of your account. If you suspect your password has been compromised for any reason, you should immediately notify us at support@join-tandem.com and change your password. Links to Other Websites and Services We may provide links to third-party websites or services. However, we are not responsible for the privacy practices employed by those web sites or services, nor are we responsible for the information or content they contain. If you follow links to websites or services not affiliated or controlled by Tandem, you should review the privacy policies and other terms and conditions governing those sites and services. Tandem is not responsible for the privacy or security of third-party websites or services. Changes to Our Privacy Policy We may update this Privacy Policy to reflect changes to our information collection and use practices. If we make any material changes we will notify you by means of a notice on this Website prior to the change becoming effective.
